1. Acceptance of Terms

By downloading, installing, or using CRE Flyer Maker ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including both free and paid subscribers. Additional terms may apply to specific features or services within the App.

2. License Grant

2.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your iOS devices
• Use the App for your personal or business purposes
• Create, edit, and share property flyers using the App
• Access and use the features available in your subscription tier

2.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App for any unlawful purpose
• Share your account credentials with others
• Use the App to compete with our services

3. Subscription Terms

3.1 Subscription Plans

CRE Flyer Maker offers the following subscription options:

• Free Tier: Limited features with up to 2 flyers
• Pro Monthly: Full access to all features, billed monthly
• Pro Annual: Full access to all features, billed annually with savings

3.2 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

3.3 Free Trial

New users may be eligible for a free trial period. If you don't cancel before the trial ends, you will be charged for the subscription. Trial eligibility is determined by Apple and may be limited to one per user.

3.4 Cancellation

You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

3.5 Price Changes

We reserve the right to change subscription prices. Price changes will not affect existing subscriptions until renewal. You will be notified of price changes in advance.

4. User Content and Data

4.1 Your Content

You retain ownership of all content you create using the App, including:

• Property information and descriptions
• Photos and images you upload
• Flyers and marketing materials you create
• Contact information and branding elements

4.2 License to Use Your Content

By using the App, you grant us a limited license to:

• Store and process your content to provide the service
• Display your content within the App interface
• Generate flyers and export files containing your content
• Backup your content for service reliability

4.3 Content Responsibility

You are solely responsible for the content you create and share. You represent and warrant that:

• You own or have the right to use all content you upload
• Your content does not violate any laws or third-party rights
• Your content is accurate and not misleading
• You have permission to use any photos of properties

4.4 Data Storage

Your content is primarily stored locally on your device. Some data may be stored on our servers for backup and synchronization purposes. We implement appropriate security measures to protect your data.

5. Prohibited Uses

5.1 Unacceptable Conduct

You agree not to use the App for any of the following prohibited activities:

• Creating false, misleading, or fraudulent property listings
• Violating any local, state, national, or international laws
• Infringing on intellectual property rights of others
• Harassing, threatening, or discriminating against others
• Attempting to gain unauthorized access to our systems
• Distributing malware, viruses, or harmful code
• Spamming or sending unsolicited communications
• Using the App to compete with our services

5.2 Real Estate Compliance

When using the App for real estate purposes, you must:

• Comply with all applicable real estate laws and regulations
• Include required disclosures and disclaimers
• Respect fair housing laws and anti-discrimination policies
• Obtain proper licensing and authorization as required
• Ensure accuracy of property information and pricing

5.3 Enforcement

We reserve the right to investigate and take appropriate action against users who violate these Terms, including suspension or termination of accounts.

6. Intellectual Property

6.1 Our Intellectual Property

The App and all related technology, including but not limited to:

• Software code and algorithms
• User interface and design elements
• Templates and layout designs
• Trademarks, logos, and branding
• Documentation and help materials

are owned by us and protected by intellectual property laws. You may not use our intellectual property without explicit permission.

6.2 Third-Party Content

The App may include third-party content, libraries, or services. Such content is owned by the respective third parties and subject to their terms and licenses.

6.3 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without compensation or attribution.

7. Privacy and Data Protection

• Assume responsibility for your business practices

9. Limitation of Liability

9.1 Exclusion of Damages

To the maximum extent permitted by law, we shall not be liable for any:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities

• Damages resulting from third-party actions
• Damages exceeding the amount you paid for the App

9.2 Maximum Liability

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

9.3 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your content or business practices
• Your violation of any third-party rights

10. Termination

10.1 Termination by You

You may terminate your use of the App at any time by:

• Cancelling your subscription through your Apple ID settings
• Deleting the App from your devices
• Ceasing to use our services

10.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice, if you:

• Violate these Terms
• Engage in prohibited activities
• Fail to pay subscription fees
• Use the App in a way that harms our services or other users

10.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must cease all use of the App
• We may delete your account and data
• Provisions that should survive termination will remain in effect

10.4 Data Retention

After termination, we may retain your data for a reasonable period to comply with legal obligations or resolve disputes. You can request data deletion by contacting us.

11. Governing Law

11.1 Applicable Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

11.2 Dispute Resolution
